Class Action Lawsuit is Filed Against Retail Giant For Not Paying New York Workers “On Time”
On May 7, 2021 the Moser Law Firm filed a class action against Bed Bath & Beyond, Inc. for not paying New York workers “on time”.
New York has unique requirements for paying “manual workers.” A “manual worker” is any employee who spends at least 25% of his or her workday engaging in “physical tasks.” New York requires employers to pay “manual workers” on a weekly basis. In addition, all wages must be paid within 7 days after the end of the workweek in which the wages are earned. An employer who pays manual workers every two weeks violates the New York Labor Law and may be required to pay LIQUIDATED DAMAGES. For most employees, liquidated damages amount to the wages that were delayed, or approximately 1/2 of an employee’s TOTAL ANNUAL COMPENSATION. These are referred to as “delayed wage” claims.
The Moser Law Firm was the first firm to win a delayed wage claim in federal court in the case of Scott v. Whole Foods, 18-cv-00086(SJF)(AKT). In that case, the Judge ruled that an employer who pays manual workers every other week in the State of New York may have to pay the employees “liquidated damages, reasonable attorneys' fees, costs, and pre-judgment and post-judgment interest.”
The lawsuit, entitled Hess v. Bed Bath & Beyond, Case No. 21-CV-4099, was filed in the United States District Court for the Southern District of New York and has been assigned to U.S. District Judge Analisa Torres.
